1. General

1.1 Silmäasema’s Eyewear protection plan is an extended repair and maintenance service for glasses or prescription sunglasses. The benefits of the eyewear protection plan complement the customer’s rights under the Consumer Protection Act.

1.2 Silmäasema’s glasses and prescription sunglasses are covered by statutory liability for defects. They always include a two-year quality guarantee, regardless of the eyewear protection plan Silmäasema offers.

1.3 The quality guarantee covers all manufacturing defects related to frames, lenses or grinding work. Silmäasema is responsible for ensuring that the lenses are correctly fitted in the frame, are of good optical quality, comply with regulations, and that the work is free from defects.

1.4 The eyewear protection plan covers the repair of breakages, scratches and other damage to glasses in accordance with these terms.

1.5 All repair and maintenance matters related to the eyewear protection plan are handled at Silmäasema’s stores. Damaged glasses or their parts will remain in the possession of the store that provided the eyewear protection plan once the repair has been completed, or new glasses have been provided.

1.6 The eyewear protection plan must be purchased in connection with the purchase of glasses, either at the time of purchase or delivery of the glasses. It isn’t possible to obtain the eyewear protection plan later.


2. Scope of the eyewear protection plan

2.1 Coverage under the eyewear protection plan

2.1.1 The eyewear protection plan covers the repair and maintenance of broken, scratched or otherwise damaged glasses. Repair and maintenance are carried out with spare parts of the same quality and from the same manufacturer where possible.

2.1.2 If the glasses cannot be repaired, the eyewear protection plan allows the purchase of replacement glasses at a discount specified in section 3 below.

2.1.3 If the damage is to lenses, they will be repaired with their original prescription if less than six (6) months have passed since the eye examination. If it is more than six (6) months since the eye examination, Silmäasema will test the customer’s vision free of charge. The glasses covered by the eyewear protection plan are updated to meet the customer’s current vision needs.

2.2 The benefits under the eyewear protection plan cannot be used in the following cases:

2.2.1 Damage resulting from normal wear and tear of the glasses or their parts.

2.2.2 Intentional or grossly negligent damage to the glasses, or their parts.

2.2.3 Damage to the glasses, or their parts, caused by fire.

2.2.4 Damage to the glasses, or their parts, covered by the statutory warranty or the manufacturer’s warranty.

2.2.5 Where the customer has received compensation for the damaged glasses, or their parts, under their own insurance. The eyewear protection plan is not an insurance policy.

2.2.6 Where the glasses are lost or stolen.


3. Fees for the eyewear protection plan

3.1 A one-time service fee for the eyewear protection plan repair and maintenance service is charged when the eyewear protection plan is purchased. The fee for the eyewear protection plan depends on the lens type: single vision €39; progressive €59. The fee is non-refundable.

3.2 The eyewear protection plan primarily covers 75% of the repair costs of the original product. The eyewear protection plan includes repair and maintenance costs of the glasses up to a maximum of 75% of the glasses’ original list price. The customer always pays the remaining share (25%).

If the original product proves to be unrepairable, the eyewear protection plan covers the purchase of replacement glasses at a 75% discount as a secondary option, calculated from the original product’s list price. The discount is 75% of the original product’s list price. The customer always pays the remaining share (25%).

The customer will primarily be provided with frames from the same price group and lenses with the same features as the lenses of the original glasses.

3.3 If the replacement glasses’ list price is higher than that of the original glasses, the share payable by Silmäasema will not exceed 75% of the original glasses’ list price.


4. Reporting damage to glasses

4.1 The customer must immediately report any damage to any Silmäasema store. We recommend that it be reported to the store where the glasses were purchased. When reporting damage, the customer must present a glasses card indicating the validity of the eyewear protection plan and proof of purchase.

4.2 The customer must provide accurate and complete information about the cause and extent of the damage. The broken or damaged glasses must be presented in-store.

4.3 The damage must be reported no later than one (1) month after the product has been damaged.

4.4 If the customer fails to comply with the obligations under clauses 4.1–4.3, the customer will lose their rights under the eyewear protection plan unless Silmäasema decides otherwise at its sole discretion.


5. When does the eyewear protection plan take effect?

The eyewear protection plan takes effect when the glasses are handed over.


6. How long is the eyewear protection plan valid?

6.1 The benefits under the eyewear protection plan end when the customer has acquired replacement glasses under the eyewear protection plan.

6.2 If the glasses are only partly damaged, and the repair of the damage does not require new glasses, the customer only pays the deductible. In this case, the eyewear protection plan will remain in effect.

6.3 However, the benefits under the eyewear protection plan will expire no later than two years after the eyewear protection plan takes effect.


7. Applicable law

7.1 The law of Finland will apply to the eyewear protection plan agreement.

7.2 Any disputes arising from the eyewear protection plan agreement will be settled in the competent court at the customer’s place of residence.
